1. Access
1.1 You are provided with access to this Site in accordance with these Conditions and any orders placed must strictly be placed in accordance with these Conditions
1.1.1 We are ABASK and we own and operate this Site
1.1.2 Your use of the Site is subject to these Conditions. By using the Site, you will be deemed to have accepted and agreed to be bound by these Conditions.
1.2 We provide the Site on an ‘as is’ basis and make no representations as to the quality completeness or accuracy of any content made available on the Site. To the maximum extent permitted by law we exclude:
1.2.1 All conditions, warranties and other terms that might otherwise be implied by law into these Conditions
1.2.2 Any and all liability to you, whether arising out of these Conditions or otherwise in connection with use of the Site.
Nothing in these Conditions is intended to exclude or limit any liability that may not by law be excluded or limited, in particular, none of the clauses are intended to limit any rights you may have as a consumer under local law or other statutory rights which may not be excluded.
1.2.3. To be eligible to purchase Items on this Website you must:

a) be the holder of a valid debit/credit card.
b) warrant that the personal information which you are required to provide when you register as a customer is true, accurate and current in all respects.
If your personal information changes then please notify us immediately by contacting our client service team.
You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.
By using this site you agree to comply with, and be bound by, these Terms.
We may from time to time change these Terms at our sole discretion. By using this Website after any such change(s), you agree to comply with, and be bound by, the Terms as changed.
2. Our rights
We reserve the right to:
2.1 Modify or withdraw, temporarily or permanently, this Site (or any part thereof) with or without notice to you.
2.2 Restrict your access to the Site or part of it. If we grant you access to a restricted part of the Site we may withdraw permission at any time.
2.3 Make changes to our Conditions from time to time. We will notify you of these changes of use by posting the revised versions of these Conditions on the Site. You can determine when we last changed these Conditions by the ‘Last updated’ statement above.
2.4 Protect our Intellectual Property rights in the Site, including all of the text, pictures, videos and other content made available on the Site. You acknowledge and agree that:
2.4.1 All Copy Right, Trademarks and all other Intellectual Property rights which form part of the website shall remain at all times our property.
2.4.2 All material contained on this website is only available for your personal use, excluding commercial use.
2.4.3 You agree not to copy, reproduce, transmit, publish, display, distribute, commercially exploit or create any part of our website, including all intellectual property rights unless expressly preauthorised and permitted by us.
2.5 If you in any way, whatsoever, breach clause 2.4 we reserve the right to claim damages against you, for your breach of our intellectual property rights and demand that you stop using the content taken from our Site immediately.
3. Use
Your permission to use the Site is personal to you and non-transferable, and you may not use the Site for commercial purposes, unless our written permission is given. Your use of the Site is conditional upon the rules set out in these Conditions and you agree that you will not:
3.1 use the Site for any fraudulent or unlawful purpose;
3.2 use the Site to defame, abuse, harass, stalk, threaten or otherwise violate the rights of others, including without limitation others privacy rights or rights of publicity;
3.3. impersonate any person or entity, falsely state or otherwise misrepresent your affiliation with any person or entity in connection with the Site;
3.4 interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available;
3.5 transmit or otherwise make available in connection with the Site any virus, worm, Trojan horse or other computer code that is harmful or invasive or may or is intended to damage the operation of, or to monitor the use of, any hardware, software of equipment;
3.6 remove any copyright, trade mark, or other propriety rights notices from the Site or materials originating from the Site;
3.7 frame or mirror any part of the Site without our express prior written consent;
3.8 reproduce the presentation of the Site.
4. Third party links
4.1 To provide suggestions or easier use we may provide links to other websites. You acknowledge and agree that we are not responsible for and do not endorse such external websites or resources. Your use of the third party websites is at your own risk.
5. How to order our products
5.1 Orders can be placed online or through our client service team.
5.2 Having placed an order you will receive a total of two emails providing you have provided a valid email address:
5.2.1 The first email is a confirmation email which you should receive immediately after your order is placed. If for any unusual reason there is a problem you will be contacted promptly and if your order cannot be met or if there is a delay in dispatch you will be notified. We will not collect any funds until we are ready to dispatch your items except for Paypal transactions. Please note some banks will reserve the funds for a short period of time before payment is due. A confirmation email does not guarantee that we can meet your order.
5.2.2. Unless we have notified you that we do not accept your order or you have cancelled your order in accordance with the Returns policy set out in section 3b below, our acceptance of your order and the completion of the contract between you and us will take place when you receive an email from us notifying you that we have dispatched the Items ordered by you.
5.2.3. Our acceptance of your order will be deemed complete and received by you at the time and date of sending of the email, which time and date is specified on the email. The deemed time and date of receipt by you shall apply regardless of whether, for reasons outside our control, you have not received that email.
5.2.4. If you require any information regarding your order(s) please contact our client service team.
5.2.5.We may not accept your order if (i) an item you have ordered is out of stock, (ii) if your card is due to expire within 28 days of your purchase date (iii) we are unable to obtain authorisation for your payment or (iv) if we identify a product or pricing error. We reserve the right to reject any offer to purchase by you at any time and at our sole discretion.
5.2.6. If we are unable to fulfil your order following our order acknowledgement, we will contact you by email or telephone advising you of this. See the Returns policy set out in section below.
5.2.7. We will try to keep our Website as up to date as reasonably possible, but cannot guarantee that any particular Item will always be available. If we can't supply any Item we will release the funds being held in your account for the purchase.
5.2.8. To ensure shopping with ABASK is as safe as possible, we may require additional details from you as part of our fraud screening process. If this happens, our client service team will contact you via phone, email or your preferred contact channel.
6. Price
6.1 Prices are as displayed based on currency and location. Currency is picked up by the IP address on a customer’s first visit to the Site. You can change your country via the country selector in our footer.
6.2 Prices displayed exclude delivery charges where applicable. Please see the Delivery section below for details on tax and duties inclusion.
6.3 Prices of some brands may vary between certain territories.
6.4 Please note we accept US dollars, Euros, British Pounds, Japanese Yen and Australian Dollars. Your shipping country may determine which currency you can shop in.
7. Payment
7.1 We partnered with Global-e, a third-party service acting as your seller-on-record, so you can shop at ABASK. When being charged, the descriptor you will see shall include Global-e identified as “Global-e” and will substantially look like this: **Global-e/ Abask ** and the purchase is subject to Global-e’s Terms and Conditions and Privacy Policy.
7.2 Payment when ordering online can be by credit and debit card, Apple Pay, Paypal, as well as Alipay (China and Hong Kong only), WeChat (China only), Mistercash (Belgium only), Mobile Pay (Denmark only), iDeal (Netherlands only) and Twint (Switzerland only).
7.3 Please note that we do not accept cheques or bankers drafts as a payment method.
7.4 To ensure that shopping online is secure, your credit/debit details will be encrypted so as to minimize the risk of your details being read by an unauthorized individual as they are sent to us over the Internet.
7.5 Please note that orders can only be placed in Sterling, Euros, US Dollars, Japanese Yen and Australian Dollars.
7.6 Order on Request products: there are some products on our site that we don’t hold stock of but they are available to order. Please contact us for enquiries. The estimated timescale that the order of request product is expected to arrive into our warehouse and then be shipped to the customer (once an order has been placed by the customer) is displayed in weeks, for example ‘stock expected 7 – 8 weeks’.
7.7 The stock expected timeframe is an estimation only, if an order is placed for an order on request product we will update you of any changes to this timeframe.
7.8 When placing an order for an order on request product, we will take payment at the time of placing the order, and we will then order the stock on your behalf.
7.9 When placing an order for an order on request product, you agree that you will not be receiving the product within 30 days, instead, you agree that you will be receiving the product in the estimated timeframe confirmed by our client service team which will be confirmed via email.
8. Returns and Cancellations
8.1 Please read our return policy carefully to ensure you can proceed with your request as quickly as possible.
8.2 All returns should be sent back to us in their original packaging provided. Please ensure when returning the parcel that the ABASK box is adequately protected.
8.3 You have 14 days from receipt of order to request your return, confirmation of your return will be emailed to you. Unsuitable items must then be returned within 14 days of receiving your returns confirmation. Returns outside this window may be accepted at our discretion. The item(s) should be returned unused and in perfect condition, with all ABASK and brand tags still in place. Returns that are damaged, used or returned without their original labels may not be accepted and may be sent back to the customer.
8.4 To ensure your return is covered by our free returns policy and does not encounter a delay, items must be returned using the original packaging provided including the original inner box and from the same country to which they were delivered. Items returned from a different country may incur additional charges or be delayed by customs. You can return using any secure means but we may not accept liability.
8.5 Before your parcel leaves our warehouse, it is fully checked and controlled by our packing team. If you receive an item which is damaged, please contact us immediately.
8.6. If your item is faulty (i.e. received damaged or with a manufacturing fault), we can offer alternatives such as repair or exchanges. For more information, please contact our client service team.
8.7 If we notice that you have a high returns rate on your account, then we may take the decision to deactivate your account until we can understand a little more about what's not quite working for you. We will contact you via email if we deem this an appropriate course of action - our client service team will help to resolve the issue with you.
8.8 All successfully returned items will be only credited to the account used originally to purchase the items, less any taxes, import duties or original shipping charges incurred and will be refunded in the currency in which you paid at the price you paid at the exchange rate prevailing on the day when you bought the item. For more information about our returns process, please see our Returns Policy or contact our client service team.
8.9 Please note, for returns from orders shipped to Australia, Bahrain, European Union, Hong Kong, Iceland, Japan, Korea (South), Kuwait, Liechtenstein, Macau, New Zealand, Oman, Qatar, San Marino, Saudi Arabia, Singapore, Switzerland, Taiwan, United Arab Emirates and United Kingdom, duty and/or tax will be fully refunded. Customers returning orders from Canada and United States of America will have their duty refunded but not the sales taxes as they are not included in the original retail price. Returns from orders shipped to all other countries, duty and/or tax will not be refunded.
8.10 Our returns policy does not affect your statutory rights in any way.
8.11 Statutory Cancellation Rights
8.11.1 You have the right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are in the EU.
8.11.2 You may cancel your order within 14 days after the day on which you receive your Items.
8.11.3 If, for any reason, you wish to cancel your order before your Items have been despatched, you need to let us know. In order to do so, you will need to contact our client service team. If you cancel your order, we will reimburse all payments received from you, including the cost of delivery within 14 days (except for any supplementary costs arising if you choose a type of delivery other than the least expensive type of standard delivery offered by us).
8.11.4 If you wish to cancel after the Items have been despatched, then you need to let us know within 14 days after the day on which you receive your Items. You can notify our client service team as identified above. Once we have received notification from you of your wish to cancel your order, you will then have a further 14 days to return your Items to us. You will have to bear the direct cost of returning the Items.
8.11.5 We may make a deduction from the reimbursement for loss in value of the Items, if the loss is the result of unnecessary handling by you.
8.11.6 Please note we do not have an exchange policy.
8.11.7 Customers need to use return service provided by ABASK. If the customer does not use the ABASK return service and the return is damaged in transit, then the customer will be responsible for all associated costs.
9. Cancellation by us
9.1 We reserve the right to cancel the contract between the customer and ABASK if:
9.1.1 We have insufficient stock to deliver the goods you have ordered.
9.1.2 We do not deliver in your area.
9.1.3 One or more of the goods you ordered was listed as the incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
9.2 If we cancel your contract we will notify you by email and will credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for consequential loss or disappointment suffered.
10. Delivery

10.1 Our aim is to deliver all orders within the specified times once receipt of payment has been confirmed. All deliveries are subject to stock availability and security checks. Delivery will be made to the address provided. If the product is paid for by PayPal it will be delivered to the address which is chosen at point of purchase with PayPal. The ABASK site is unable to change the address due to PayPal’s security policy.
10.2 Whist we will make every effort to deliver within the time stated on our website, we will not be liable for any loss caused to you by late delivery or for late deliveries as a result of Carrier actions which are beyond our control save as precluded by law. Please contact us as soon as possible if you do not receive your goods within a reasonable time. We will endeavour to get your goods to you as soon as possible or you may cancel your order. You will be refunded once the goods have been returned to us in good order or classified as lost by the Carrier Company.
10.3 We will attempt to deliver your order to the delivery address stated on your order form. ABASK will not be liable for any missing parcels should the delivery address have been entered incorrectly. If products are returned to us as undeliverable either because of an incorrect address or because of customer failure to contact the courier company or collect the goods from the depot where requested, we shall refund the price of the products less delivery costs incurred by us in sending out the goods plus any additional costs charged to us by the courier company for returning the goods to us. If we have to re-dispatch the order, if it has been returned to us, for reasons outside of our control there may be a charge.
10.4 If the products we deliver to you are damaged or we have sent you the incorrect goods or quantity, please contact us within seven (7) days of delivery. We require you to notify us within seven (7) days to ensure a prompt response from us. Please do not sign for any packages that are damaged or opened. We cannot accept any liability for goods which are damaged or sent in error unless you notify us pursuant to these terms and conditions.

10.6 All our deliveries are sent out using a signed for courier service. For security purposes, we do not deliver to P.O. Box numbers.
10.7 Customers purchasing from Australia, Bahrain, European Union, Hong Kong, Iceland, Japan, Korea (South), Kuwait, Liechtenstein, Macau, Malaysia, New Zealand, Oman, Qatar, Saudi Arabia, Singapore, Switzerland, Taiwan, United Arab Emirates, United Kingdom and United States will have orders delivered duty paid. These costs are included in the final purchase price, and you should not have to pay any additional costs to receive your order.
10.8 Customers purchasing from Albania, Antigua and Barbuda, Argentina, Aruba, Bahamas, Bangladesh, Barbados, Belize, Benin, Bermuda, Bolivia, Bosnia and Herzegovina, Botswana, Brazil, Brunei Darussalam, Chile, China, Colombia, Costa Rica, Dominica, Dominican Republic, Ecuador, Egypt, El Salvador, French Guiana, Gibraltar, Grenada, Guadeloupe, Guatemala, Guyana, Honduras, India, Indonesia, Israel, Jamaica, Jersey, Jordan, Kenya, Lebanon, Maldives, Martinique, Mauritius, Mexico, Montserrat, Morocco, Namibia, Nicaragua, Nigeria, Pakistan, Panama, Papua New Guinea, Paraguay, Peru, Philippines, Puerto Rico, Reunion, Saint Kitts and Nevis, Saint Lucia, Senegal, Serbia, Slovak Republic, South Africa, Sri Lanka, Swaziland, Tanzania, Thailand, Trinidad and Tobago, Turkey, Turks and Caicos Islands, Uruguay and Vietnam will have orders delivered duty unpaid (DDU) and will be charged for the items purchased and shipping costs only. Import duty or tax costs (where applicable) will be invoiced to you directly from DHL or an import broker appointed by you. We recommend you contact your local customs authority to determine a landed cost price prior to purchase completion, as some countries have thresholds where no import taxes or duty fees will need to be paid.
10.9 All other countries, will be given an option to ship either delivery duty paid or delivery duty unpaid.
10.10 For customers that are shipping to countries with delivery duty unpaid (DDU), please be aware that when you return an item back to us - as per our Returns Policy, you will be refunded the item amount but you will not be refunded import duties and/or tax costs.
10.11 Customers returning orders from Canada and United States of America will have their duty refunded but not the sales taxes as they are not included in the original retail price.
10.12 If you are ordering products to be delivered to someone else, please make sure they are aware they will be responsible for these additional charges. We have no control over these charges and cannot predict what they may be, so we are unable to offer any assistance on these processes. We would advise that you check the import charges applicable in any country before ordering products to be delivered there.
10.13 Please note that we aim to dispatch all orders within 1 business day. Estimated delivery times are to be used as a guide only and commence from the date of dispatch. ABASK is not responsible for any delays caused by destination customs clearance processes
11. Vouchers and Promotional Discounts
11.1 You may occasionally receive discount codes from us, via email or through promotional materials.
11.2. Each code is unique to the recipient, is not transferable, has no monetary value and under no circumstances can it be converted into currency. Each code has an expiry date, which will be stated at the time of promotion or on accompanying promotional materials which cannot be modified. Some discount codes may be redeemed both in store and online, or when specified, for online purchases only. Again, this will be stipulated at the time of promotion and on accompanying promotional materials.
11.3 When an order is placed using a promotional code and contains a number of items, the value of the discount is spread over each item according to the pro-rated value of that item. Any refund of an item purchased in such an order will be reduced by the value of discount attached to it. The ‘discount’ will not be refunded.
11.4 Under no circumstances can the value of a discount code be deducted from an order if that code is defective or out of date: no replacement codes will be issued.
12. Liability
12.1 If the goods you receive are incorrect, damaged or defective, or you’ve received an incorrect quantity, we require you to notify us in writing at our contact address within 7 days (standard orders). We cannot accept any liability unless you notify us in accordance with these terms and conditions. All original packaging must be kept for damaged items as proof of the condition the goods were received in.
12.2 If you notify a problem to us under clause 20.1 or 20.2 above, our only obligation will be, at your option:
12.2.1 To make good any shortage or non-delivery
12.2.2 To replace or repair any goods that are damaged or defective where it is proportionate and possible to do so; or
12.2.3 To provide a refund to you of the amount paid by you. All rights are reserved as to the manner or form of refund
12.2.4 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expense (including loss of profits business or goodwill) howsoever arising out of any problem you notify to us under this condition. Save as precluded by law we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods.
12.2.5 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our Site. The importation of certain goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
12.2.6 Nothing in these Conditions is intended to limit any rights you may have as a consumer neither under applicable local law or other statutory rights that may not be excluded nor in any way to exclude liability for any death or personal injury resulting from our negligence.
13. Events beyond our control
13.1 We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstances beyond our reasonable control including without limitation, strikes, lock outs and other industrial action, breakdown of system or network access, flood, fire, explosion or accident.
14. Invalidity
14.1 If any part of these Conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part these conditions will not be affected.
15. Entire Agreement
15.1 These Conditions, together with our current website process, additional terms and conditions for specific products, delivery details, contact details, privacy policy, set out the whole of our agreement relating to the supply of goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any good offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
16. Complaints/ Feedback/ Recommendations
16.1 Please feel free to give us any feedback, recommendations or comments about our services and website. We take this very seriously and aim to deal with any problems or difficulties in a timely fair and effective manner. Please contact us - we try to respond to any enquiries within one business day.
17. Governing Law
17.1 Your use of this Website and any purchase by you of any Item from ABASK shall be governed by English law and you hereto submit to the exclusive jurisdiction of the English courts.
Definitions
‘ABASK’ is the trading name of and means FXWL Limited (Company Number 13689661)
‘Conditions’ means these terms and conditions
